NeoCharge Canadian Rewards Program Terms

The short version, in plain English

This summary is for convenience; the full terms below govern.

  • Canadian customers get rewards for connecting a Smart Splitter to the NeoCharge app and verifying it — currently a CAD 200 reward per eligible Smart Splitter, paid back on your original purchase, plus discounted Canadian pricing at checkout.
  • The program is funded by Canada's Clean Fuel Regulations: your connected, verified charger lets NeoCharge and its credit partner create clean-fuel credits, and federal rules require that credit revenue be reinvested into EV drivers and charging.
  • You own your charger. Connecting it never transfers ownership to us.
  • We own the credits and the charging records used to create them. Your rewards are what you receive for participating — they are not a share of credit sales.
  • One program per charger. Don't enroll the same charger, address, or charging in another carbon-credit or similar program — double counting cancels credits for everyone.
  • We may offer additional rewards later (for example, monthly rewards for home charging). If we do, they'll have their own published terms — nothing here is a promise of future rewards.
  • You can disconnect and leave anytime. Rewards you've already earned are still honoured; charging records and credits from before you left stay with the program (federal rules require us to keep those records for at least 10 years).

Program Terms

Program operator: The Program is operated jointly by NeoCharge Canada Inc. and NeoCharge, Inc., together with their affiliates and designated program partners ("NeoCharge," "we," "us"). NeoCharge Canada Inc. administers the Program in Canada, including Canadian sales and reward payments.

These terms apply when you participate in the NeoCharge Canadian Rewards Program (the "Program") — including when you claim a Program reward, accept a Program refund, or connect a device to the NeoCharge app in connection with a Program offer. They supplement the NeoCharge website terms, app terms, privacy policy, and product warranty. If there is a conflict about the Program, these terms control.

1. What the Program is

The Program rewards eligible Canadian EV drivers for connecting approved charging devices (such as the NeoCharge Smart Splitter) to the NeoCharge app and keeping them connected, so that NeoCharge can measure, validate, and report eligible residential EV charging under Canada's Clean Fuel Regulations (SOR/2022-140, the "CFR") and similar programs. Rewards are consideration for your participation, data access, and assignment of the rights described in Section 6. You do not own the credits or credit-sale proceeds, and the Program does not make you a partner, joint venturer, broker, fiduciary, or profit-share participant of NeoCharge.

2. Eligibility

  • You are a resident of Canada and the age of majority in your province or territory.
  • You have legal authority over the device, service address, and charging account you connect. If you rent or live in a strata/condo, you may participate if you pay for or are authorized to use the electricity used for charging and have any permission required for the device's installation.
  • You own, lease, or have regular use of an electric vehicle that you charge with the device. Actual EV charging is required to earn rewards — the Program creates clean-fuel credits from real EV charging, so we verify it before paying.
  • The device is used primarily for residential EV charging in Canada.
  • One reward account per person and per service address; one enrollment per device, unless we approve otherwise in writing.
  • The same device, address, or charging is not enrolled in another incompatible carbon-credit, clean-fuel, or similar rewards program (Section 7).

We may approve or deny participation, require additional verification, or limit eligibility by province, device, installation type, or regulatory requirement.

3. Current rewards

(a) Canadian checkout pricing. Eligible Canadian orders receive discounted pricing shown at checkout. The discount is applied automatically in the price; amounts may change and are as shown at the time of purchase.

(b) Connection reward — CAD 200 per Smart Splitter. If a written NeoCharge offer (email, page, or app message) invites you to claim it, you can receive CAD 200 per eligible Smart Splitter that you connect to the NeoCharge app and verify. Conditions:

  • the device is tied to an eligible order as described in the offer (rebates are paid as a refund against the original order; purchases we cannot verify or refund against — for example, marketplace purchases — are excluded unless the offer says otherwise);
  • the order was not returned, refunded, or charged back;
  • you have a NeoCharge app account whose home address matches the order's shipping or billing address (or you verify your identity another way we accept);
  • the device is connected and online, and its use for EV charging is confirmed;
  • you meet any additional conditions stated in the offer, such as a connection deadline (for example, connecting within 30 days of delivery);
  • one reward per device — a device that has already earned a connection reward for any account is not eligible again.

The reward is paid as a refund to the original payment method (or another method we state in the offer), with the memo "NeoCharge Canadian Rewards Program."

(c) Future rewards. We may offer additional rewards — for example, ongoing rewards for home charging. Any such offer will have its own published terms and rates. Nothing in these terms commits NeoCharge to offer, continue, or fund any future reward, and "coming soon" descriptions are not offers.

4. Verification and audits

Rewards are paid only after verification. We may verify device serial number and connectivity, service address and province, order details, app account identity, and that the device is genuinely charging an EV — for example, through the device's charging data and load signature, or by asking for your vehicle's make and model. Charging a non-EV load (a dryer, heater, or other appliance) does not qualify and presenting it as EV charging is prohibited conduct under Section 8. We may use network signals (such as the device's reported public IP country) as a fraud and compliance signal alongside other evidence. Credits created from Program charging are subject to third-party verification and federal audit; you agree to cooperate with reasonable requests for supporting evidence (proof of purchase, installation, address, or authority) and to provide accurate information. We may delay or decline rewards until verification is complete.

5. Charging data ownership and consent

Data ownership. Under the CFR, only a charging-network operator that owns the charging data may create clean-fuel credits from it. Accordingly, as between you and NeoCharge, NeoCharge owns the charging session records, metering data, and aggregated or processed charging data generated by connected devices in the Program ("Charging Records"). You keep access to your charging history in the app, and your personal information remains protected by our privacy policy and applicable privacy law. This covers records and measurements only — it gives NeoCharge no ownership of your charger, home, vehicle, or electricity account.

Consent. By participating, you authorize NeoCharge and its program partners to collect, use, disclose, and retain your account, device, address, order, charging-session, and device network information (including the device's reported public IP, used to confirm the device is operating in Canada) to: operate the Program; verify eligibility and prevent fraud and double counting; pay, correct, or reverse rewards; create, verify, report, transfer, and sell credits and environmental attributes; and support our registered credit creator, Environment and Climate Change Canada, auditors, verifiers, and professional advisors. Data may be stored or processed in Canada or the United States, subject to applicable privacy law and contractual safeguards. Because the CFR requires records supporting credit creation to be kept for at least 10 years, some Program data cannot be deleted immediately on request — we will tell you what must be kept and why if you ask.

6. Environmental attributes and credit rights

For each connected device and eligible charging session, you assign and grant to NeoCharge and its designated program partners — including the registered credit creator that creates credits on NeoCharge's behalf under the CFR — the exclusive right to collect, aggregate, validate, report, register, create, claim, verify, sell, transfer, monetize, and retain all credits and environmental attributes associated with the eligible charging data, to the fullest extent permitted by law. "Environmental attributes" includes compliance credits, clean-fuel credits, carbon credits, offset credits, reporting rights, reductions, claims, benefits, units, proceeds, and any other environmental value associated with eligible EV charging under the CFR or any similar federal, provincial, territorial, utility, voluntary, or successor program.

You agree that NeoCharge or its designated partner — not you — is entitled to claim and monetize those credits and attributes; that you will not sell, register, or formally claim credits or emission reductions from the same charging in any other program or market (describing your driving as electric or clean in everyday, non-commercial contexts is of course fine); and that you will sign reasonable confirmations of this assignment if a registry, verifier, or regulator requires them. These rights survive your withdrawal for data and charging collected before withdrawal and for credits already created, reported, pending, sold, or under verification.

7. No double enrollment

Double counting is fatal under the CFR — the same kWh claimed twice creates no credits at all. You must not enroll the same device, address, sessions, or attributes in another incompatible carbon-credit, clean-fuel, utility-credit, or similar rewards program, and you authorize NeoCharge to make reasonable checks with device makers, charger platforms, registries, verifiers, and other programs to confirm no conflicting claim exists. Participation in a separate utility demand-response or rebate program that does not claim credits on the same charging is generally compatible — ask us if unsure.

8. Corrections, reversals, and fraud

We may withhold, correct, or reverse a reward if the order is returned, refunded, or charged back; the device is not activated or verification fails; the information provided was false or misleading; there is double enrollment or a conflicting credit claim; or there is fraud, simulated charging, non-EV loads presented as EV charging, or interference with our systems. Where we reverse or adjust, we will tell you what changed and why, and you can dispute it through support. Honest mistakes will not make you liable to us beyond correction or cancellation of the affected reward. We may end your participation for material breach, fraud, or prohibited conduct. If you knowingly provide false information or make conflicting credit claims, you are responsible for losses and penalties that conduct causes us.

9. Changes to the Program

We may change or end Program offers, reward amounts, eligibility, and these terms. Changes apply prospectively: a reward you have already earned under an offer's stated conditions will be honoured. For material changes that reduce your rights, we will give at least 30 days' notice by email or in the app, setting out what changed and when it takes effect, and you may decline the change by withdrawing without cost. We may make changes immediately where required by law, regulation, or a verifier or regulator instruction.

10. Leaving the Program

You may stop participating at any time by disconnecting your device or contacting support — free of charge. Earned, verified rewards are still honoured. Leaving does not affect our rights to Charging Records and environmental attributes already collected or generated, credits already created or under audit, or our record-keeping and legal obligations.

11. Taxes; safety; third-party rebates

Rewards may have tax consequences; you are responsible for your own tax obligations, and we may request tax information or report payments where required by law. You are responsible for safe installation and use of your device and compliance with electrical codes and manufacturer instructions; the Program does not change your product warranty. Utility and government rebates (including BC Hydro's) are separate third-party programs — we do not control or guarantee them, and you keep them; we do not require you to assign them to us.

12. Disclaimers and liability

The Program is provided "as is." We do not guarantee credit creation, sale, price, or timing; continued availability of any offer; or uninterrupted connectivity or app availability. To the maximum extent permitted by law, NeoCharge is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from the Program, and our total liability for Program claims is limited to the greater of CAD 100 and the rewards earned and verified for your account in the 12 months before the claim. Nothing in these terms limits rights or remedies that applicable consumer protection law does not allow to be limited, and nothing limits liability for our own gross negligence, willful misconduct, or fraud.

13. Governing law and disputes

Contact support first — most issues are resolved there. These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, and disputes may be brought in the courts of British Columbia — except that if mandatory consumer protection law in your province or territory gives you the right to other laws, courts (including small claims court), or remedies, nothing here takes that away. These terms do not require arbitration and do not waive class-proceeding rights that cannot lawfully be waived.

14. General

You may not assign your Program rights without our written consent; if you die, earned and verified rewards are payable to your estate on reasonable proof. We may assign the Program or these terms to an affiliate, successor, or program partner without reducing your rights. If a provision is unenforceable, the rest remains in effect. Sections 5, 6, 7, 8, and 10–14 survive the end of your participation. You accept these terms electronically — by claiming a Program reward, accepting a Program refund, or connecting a device after being shown these terms — and electronic records of acceptance are valid evidence of agreement. These terms plus the specific written offer you claim under are the entire agreement for the Program.
